Billionaire entrepreneur Elon Musk has reignited his legal battle with artificial intelligence startup OpenAI, accusing the company of betraying its founding mission and seeking to nullify its license to Microsoft. The suit, filed in a California federal court, highlights ongoing tensions between Musk and OpenAI over the direction and commercialization of AI technology.
Elon Musk's contentious relationship with OpenAI, the artificial intelligence (AI) startup he co-founded in 2015, has taken a new turn with the filing of a lawsuit in the U.S. District Court of Northern California. The suit revives Musk's earlier claims that OpenAI breached its founding mission of developing open-source AI technology for the benefit of humanity.
Musk, who left OpenAI's board in 2018, alleges that the company, led by CEO Sam Altman and president Greg Brockman, has abandoned its original goals and pursued commercial ventures that deviate from its non-profit objectives. The lawsuit contends that OpenAI's licensing partnership with Microsoft, under which the tech giant invests billions of dollars in exchange for access to OpenAI's AI models, violates the company's mission and scope.

Specifically, Musk asserts that OpenAI's language models, such as the popular ChatGPT, are outside the scope of the Microsoft partnership and that the license granted to Microsoft is therefore null and void. The suit seeks a judicial determination to this effect.
Musk's lawsuit follows the withdrawal of an earlier suit against OpenAI and Altman in June. The reasons for the withdrawal were not disclosed, but the renewed legal action suggests that the underlying tensions between Musk and OpenAI have not been resolved.

In response to the initial lawsuit, OpenAI's executives published a blog post detailing the company's history with Musk and disputing his claims. They revealed that Musk had proposed merging OpenAI with Tesla and sought control over the company's equity and board. They also expressed regret over the falling out with Musk, citing their recent success with ChatGPT and his subsequent launch of a rival AI company, xAI.
OpenAI has not yet responded publicly to the new lawsuit, but a spokesperson told FOX Business that "Elon's prior emails continue to speak for themselves," referring to the communications shared by OpenAI's executives in their previous blog post.
